| 6 | Penalty Clause: 1. After having been notified of the defects / service requirement during warranty period, Seller has to complete the required Service / Rectification within 7 days time limit (or as specified in other terms in contract). 2. If the Seller fails to complete service / rectification within the defined time limit, a penalty of 0 .5% of Unit Price of the product shall be charged as penalty for each week of delay from the se ller. Seller can deposit the penalty with the Buyer directly else the Buyer shall have a right to r ecover all such shall be charged as penalty or recover all such penalty amount from the Warra nty Performance Security (WPBG) for each week of delay from the seller. 3. Cumulative Penalty cannot exceed more than 5% of the total contract value after which the B uyer shall have the right to get the service / rectification done from alternate sources at the ri sk and cost of the Seller besides forfeiture of WPBG. Seller shall be liable to reimburse the cos t of such service /get the service / rectification done from alternate sources at the risk and cos t of the Seller besides forfeiture of WPBG.
